  3. The technical requirements on liens and the removal of liens is complex. section 6323(j) of the Internal Revenue Code permits with IRS to withdraw a notice of a lien in multiple situations. There are newly drafted regulations under this section of the Code, for example, that suggest the removal of a lien in circumstances where it is in the mutal interest of the IRS and the taxpayer to remove the lien. In most cases, a lien serves no purpose if a taxpayer does not own real estate.
